Article 1 (Purpose)
 The purpose of these terms of use is to stipulate the rights, duties and responsibilities of the online mall (hereinafter referred to as the “Mall”) and users in using the internet-related services (hereinafter referred to as “services”) provided by the All:ba Mall operated by Youngil Trading (e-commerce business operator).
 ※「For e-commerce transactions using PC or wireless communication, these terms of use shall apply mutatis mutandis unless they do not go against their natures.」

Article 2 (Definition of Terms)
 ① The term “Mall” refers to a virtual business site set up by Youngil Trading to provide goods or services (hereinafter referred to as “goods, etc.”) to users as a platform for trading of goods, etc. by using information and communication devices such as computers. It is also used in the sense of a business that operates an online mall.
② The term “user” refers to members and non-members who access the “Mall” and receive services provided by the “Mall” in accordance with these terms of use.
③ The term “member” refers to a person who has registered him/herself as a member of the “Mall” and who are granted to continuously use the services provided by the “Mall”.
④ The term “non-member” refers to a person who uses the services provided by the “Mall” without signing up as a member.

Article 3 (Stipulation, Explanation and Revision of the Terms of Use, etc.)
① The “Mall” shall disclose the contents of these terms of use, names of the company and CEO, business address (including the address where customer complaints are handled), phone number, fax number, email address, business registration number, communication sales business report number, and name of the privacy officer on the initial service page (front) of the All:ba Mall so that users can easily identify them. However, the "Mall" may choose to disclose the contents of these terms of use by redirecting the users to another page.
② Before a user agrees to the terms of use, the "Mall" shall provide a separate redirected page or pop-up screen to help him/her understand necessary information among the contents set forth in the terms of use, such as details on order cancellation, shipping responsibility, and refund conditions, and obtain the user's consent.
③ The “Mall” may revise these terms of use to the extent that it does not violate relevant laws, including the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Electronic Financial Transactions Act, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-Door Sales, and the Framework Act on Consumers.
④ When the "Mall" revises these terms of use, the effective date and reason for the amendment shall be specified and notified along with the original terms of use on the website of the "Mall" from seven (7) days before the effective date to the day before the effective date. However, in case the contents of the terms of use are changed unfavorably to the users, it shall be notified with a grace period of at least thirty (30) days in advance.  In this case, the "Mall" shall clearly compare the contents before and after the amendment and display them in a way that is easily understandable by users.
⑤ Where the “Mall” revises these terms of use, the amended terms shall apply only to contracts concluded after the effective date, and the provisions of the terms of use before the revision shall be applied to contracts already concluded before that date. However, if a user who has already signed a contract sends the intention to be subject to the provisions of the revised terms of use to the “Mall” within the notification period of the amended terms under paragraph (3) and obtains the consent of the “Mall”, the amended terms of use shall be applied.
⑥ Matters not stipulated in these terms of use and interpretation of these terms of use shall be governed by the Act on the Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce determined by the Fair Trade Commission, and related laws or commercial practices.

Article 4 (Provision and Change of Services)
① The “Mall” shall perform the following tasks:
  1. Provision of information on goods or services and conclusion of purchase contracts;
  2. Delivery of goods or services for which a purchase contract has been concluded; and
  3. Other tasks determined by the “Mall”.
② The “Mall” may change the content of goods or services to be provided according to future contracts in the event of a stockout of goods or services or a change in technical specifications. In this case, the contents of the changed goods or services and the date of provision shall be specified and immediately notified to the area where the contents of the current goods or services are posted.
③ In case of changes in the contents of a service contract between the "Mall" and a user due to reasons such as a stockout of goods or a change in technical specifications, the reason shall be immediately notified to the address where the user can be notified.
④ The “Mall” shall compensate the user for damages caused by the reason mentioned in the preceding paragraph. However, this is not the case if the “Mall” proves that there is no intention or negligence.

Article 5 (Suspension of Services)
① The “Mall” may temporarily suspend the provision of services in the event of maintenance, replacement or malfunction of information and communication devices such as computers, or interruption of communication.
② The "Mall" shall compensate for damages suffered by users or third parties due to the temporary suspension of the provision of services under the reasons set forth in paragraph (1). However, this is not the case if the “Mall” proves that there is no intention or negligence.
③ In the event that the services cannot be provided due to reasons such as the conversion of business items, abandonment of business, or merger, the “Mall” shall notify the users in the manner stipulated in Article 8 and compensate the consumers according to the conditions initially presented by the “Mall”. However, if the "Mall" has not notified any compensation standards, the mileage or points of each user shall be paid in kind or cash that corresponds to the currency value used in the "Mall".

Article 6 (Membership)
A user applies for membership by entering his/her information according to the registration form set by the “Mall” and by expressing that he/she agrees to these terms of use.
The “Mall” shall accept the membership among the applicants as described in paragraph (1) unless they fall under any of the following subparagraphs:
A person who had previously lost his/her membership under Article 7(3) of these terms of use, unless three (3) years have elapsed since he/she lost the membership and the "Mall" agrees to the re-registration;
A person who entered false or wrong information or omitted some details upon signing up for membership; or
If it is judged that accepting the membership request may significantly impede the "Mall" for technical reasons.
③ The conclusion of the membership contract shall be made when the consent of the “Mall” reaches the member.④ In the event that there is a change in the information registered upon sign-up, the member shall notify the "Mall" of the change, such as by modifying his/her membership information, within a reasonable period of time.

 Article 7 (Membership Withdrawal and Loss of Qualifications, etc.)
① A member may request a withdrawal from the “Mall” at any time, and the “Mall” shall immediately process the membership withdrawal.② The “Mall” may restrict and suspend his/her membership if a member falls under any of the following reasons:
In case a member enters false information when applying for membership;
In case a member does not pay his/her debts or balance in relation to the use of the “Mall” or the payment of goods, etc. purchased by using the “Mall” within the due date;
In case a member becomes a threat in the order of e-commerce, such as interfering with other people's use of the "Mall" or stealing the information; or
4. In case a member uses the “Mall” to conduct an act prohibited by laws or these terms of use or contrary to public order and morals.
③ After the “Mall” has restricted or suspended a user's membership, the “Mall” may null the membership if the user conducts the same action more than once or if the cause is not corrected within thirty (30) days.
④ If the “Mall” nulls a user's membership, the user's registration as a member shall be canceled. In this case, the member shall be notified and given an opportunity to explain by setting a period of at least thirty (30) days before his/her membership is canceled.

Article 8 (Notification to Members)
When notifying a member, the “Mall” may do so by sending an email to the address designated by the member during the conclusion of a contract with the “Mall”.
When notifying an unspecified number of members, the “Mall” may substitute individual notices by posting on the bulletin board of the “Mall” for more than one (1) week. However, individual notifications shall be made for matters that have a significant impact on a member's transaction.

Article 9 (Purchase Request and Consent to the Provision of Personal Information, etc.)
① A user of the “Mall” shall request a purchase on the “Mall” using the following or similar methods, and the “Mall” shall provide each of the following information in a way that is easily understandable by the user upon making his/her request:  
Search and selection of goods, etc.;
Entry of the recipient's name, address, phone number, email address (or mobile phone number), etc.;
Confirmation of the contents related to the terms of use, services with limited right to cancel an order, and cost burden such as shipping and installation fees;
Indication that one agrees to these terms of use and confirms or rejects the above subparagraph 3 (e.g. mouse click);
Purchase request for goods, etc. and confirmation thereof or consent to the verification process done by the “Mall”; and
Selection of payment method.
② In case the “Mall” needs to provide the buyer's personal data to a third party, the "Mall" shall notify the buyer of 1) the person receiving the personal data, 2) the purpose of using the personal data of the person receiving the data, 3) the items to be provided, 4 ) the period of retention and use of personal data by the person receiving the personal data, and obtain his/her consent. (The same applies in case of changes in the matters for which consent has already been obtained.)
③ In the event that the “Mall” entrusts a third party with the handling of the buyer's personal data, the "Mall" shall notify the buyer of 1) the person who is entrusted with the handling of the personal data and 2) the details of entrusting the handling of the personal data, and obtain his/her consent. (The same applies in case of changes in the matters for which consent has already been obtained.) However, if it is necessary for the implementation of the contract for service provision and is related to the enhancement of the buyer convenience, the "Mall" may is not required to go through the notification procedure and consent procedure by notifying through its privacy policy in the manner stipulated in the Act on Promotion of Information and Communications Network Utilization and Information Protection.

Article 10 (Conclusion of Contract)
 ①  The “Mall” may not accept the purchase request specified in Article 9 if it falls under any of the following subparagraphs. However, in the case of entering into a contract with a minor, the minor or his/her legal representative shall be notified that the contract may be canceled if the consent of the legal representative is not obtained.
1. In case of false or wrong information or omission in the application;
2. In case a minor purchases goods and services prohibited by the Youth Protection Act, such as tobacco and alcohol; or
3. If it is judged that accepting the purchase request may significantly impede the "Mall" for technical reasons.
② A contract is deemed to have been concluded when the consent of the “Mall” reaches the user in the form of a notification of confirmation of receipt as stipulated in Article 12(1).
③ In the expression of consent of the “Mall”, information on the confirmation of the user's purchase request and availability of sale, correction or cancellation of the purchase request, etc. shall be included.

Article 11 (Payment Method)
The payment for goods or services purchased from the “Mall” can be made using any of the following methods. However, the “Mall” cannot collect any fee in addition to the price of goods, etc. for the payment method selected by the user.
1. Various money transfers via phone, internet banking, or mail banking;
2. Various card payments such as prepaid cards, debit cards, and credit cards;
3. Online wire transfer;
4. Payment made by electronic money;
5. Payment at the time of receipt of goods or services;
6. Payment by points provided by the “Mall” such as mileage;
7. Payment by gift certificate contracted with or recognized by the “Mall”; or
8. Payment by other electronic payment methods.

Article 12 (Notification of Confirmation of Receipt and Change and Cancellation of Purchase Request)
① The "Mall" shall notify the user of receipt confirmation upon the user's purchase request.
② The user who received the notification of confirmation of receipt may request for change or cancellation of the purchase request immediately after receiving the notice if there is any discrepancy in the expression of intention, etc., and the “Mall” shall handle the request without delay before shipping upon receiving the request. However, if the payment has already been made, the provisions regarding the cancellation, etc. of an order in Article 15 shall apply.

Article 13 (Supply of Goods, etc.)
① Unless there is a separate agreement with the user regarding the supply period of goods, etc., the "Mall" shall take other necessary measures such as customized order and packaging so that the goods, etc. can be shipped within seven (7) days from the date of the user placed an order. However, if the “Mall” has already received all or part of the payment for goods, etc., the "Mall" shall take action within three (3) business days from the date of receiving all or part of the payment.  In this case, the “Mall” shall take appropriate measures to ensure that the user can check the supply procedure and progress of goods, etc.
② The "Mall" shall stipulate the shipping method, the person responsible for the shipping fee for each means, and the shipping period for each means for the goods purchased by the user. Where the "Mall" exceeds the contracted shipping period, it shall compensate the user for any damage. However, this is not the case if the “Mall” proves that there is no intention or negligence.

Article 14 (Refund)
The “Mall” shall notify the user of the reason without delay when the goods, etc. requested by the user cannot be shipped or provided due to reasons such as stockout. If the "Mall" has received the payment for goods, etc. in advance, it shall refund the money or take action necessary for refund within three (3) business days.

Article 15 (Cancellation, etc. of Orders)
① The user who has entered into a contract for the purchase of goods, etc. with the “Mall” may cancel his/her order within seven (7) days from the date of receiving a document in relation to the contract details (the date when the goods, etc. have been supplied or when the supply of goods, etc. has begun if the supply of goods, etc. is delayed later than the date of receiving the said document) pursuant to Article 13(2) of the Act on the Consumer Protection in Electronic Commerce. However, if there are provisions stated otherwise in the Act on the Consumer Protection in Electronic Commerce regarding the cancellation of an order, the provisions thereof shall apply.
② Where a user has already received the goods, etc., he/she who falls under any of the following subparagraphs cannot request a return or exchange:
1. In case the goods, etc. are lost or damaged due to reasons attributable to the user (except for the case where the packaging has been damaged to check the contents of the goods, etc.);
2. In case the value of goods, etc. has significantly decreased due to the user's use or partial consumption;
3. In case the value of goods, etc. has significantly decreased to such an extent that resale is not possible due to the passage of time; or
4. In case the original packaging of the goods, etc. has been damaged, although it is possible to reproduce the goods, etc. with those with the same performance.
③ In the case of paragraph (2)2 or 4, if the “Mall” does not specify in advance the fact that the cancellation, etc. of an order is restricted in a place where the consumer can easily understand the fact, or does not take measures such as providing a trial product, the user’s cancellation, etc. of an order shall not be limited.
④ Notwithstanding the provisions of paragraphs (1) and (2), where the contents of goods, etc. differ from the displayed or advertised contents or have been performed in a different manner from the terms of the contract, the user may cancel, etc. his/her order within three (3) months from the date of receiving the goods, etc. or within thirty (30) days from the date he/she knew or could have known such fact.

Article 16 (Effect of Cancellation, etc. of Orders)
① Where the "Mall" receives the goods, etc. sent by a user for a refund, the "Mall" shall refund the payment for the said goods, etc. within three (3) business days. In this case, where the "Mall" delays the refund of goods, etc. to the user, the delayed interest shall be calculated by multiplying the delayed period by the delayed interest rate prescribed in Article 21-2 of the Enforcement Decree of the Act on the Consumer Protection in Electronic Commerce and shall be provided the user.
② Where the “Mall” refunds the aforementioned payment, it shall request the business operator that provided the payment method to suspend or cancel the charge of the payment for the goods, etc. without delay in case the user has made the payment for goods, etc. using a credit card, electronic money, or other payment methods.
③ In case of a cancellation, etc. of an order, the cost required to return the supplied goods, etc. shall be borne by the user. The “Mall” shall not claim a penalty or compensation for damages from the user for the reason of the cancellation, etc. of an order. However, in case of cancellation, etc. of an order due to such reasons as the contents of goods, etc. differ from the displayed or advertised contents or have been performed in a different manner from the terms of the contract, the cost necessary for the return of the goods, etc. shall be borne by the “Mall”.
④ If the user has paid the shipping cost when receiving the goods, etc., the “Mall” shall clearly indicate who bears the cost upon the cancellation of an order in a way that can be easily understandable by the user.

Article 17 (Privacy Protection)
① The "Mall" collects the minimum amount of personal data to the extent necessary to provide services when collecting users' personal data.
② The "Mall" does not collect information necessary for the implementation of the purchase contract in advance at the time when a user signs up for membership. However, this shall not be the case when the minimum amount of specific personal data is collected in cases where identification is required prior to a purchase contract in order to fulfill the obligations under the relevant laws and regulations.
③ When the “Mall” collects and uses a user's personal data, the “Mall” shall notify the user of the purpose and shall obtain his/her consent.
④ The “Mall” cannot use the collected personal data other than the intended purpose, and in case there is a new purpose of use or in case the collected personal data is provided to a third party, the purpose of use shall be notified to the user at the stage of the use and provision, and shall obtain the user's consent. However, this is not the case if there are provisions stated otherwise in the relevant laws and regulations.
⑤ If the "Mall" needs to obtain the user's consent pursuant to paragraphs (2) and (3), the identity of the privacy officer (his/her affiliate, name, phone number, and other contact information), the purpose of collection and use of information, and matters regarding information provision to a third party (to whom the information will be provided, the purpose of provision, and the contents of information to be provided), etc. shall be stipulated or notified in advance as described in Article 22(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, and the user may withdraw his/her consent on this matter at any time.
⑥ A user may request to view or correct errors in his/her personal data possessed by the “Mall” at any time, and the “Mall” is obliged to take necessary measures without delay. If the user requests the correction of an error, the "Mall" shall not use the personal data until the error is corrected.
⑦ The "Mall" shall limit the persons handling the user's data to a minimum for personal data protection, and the “Mall” shall be responsible for any damage to a user caused by the loss, theft, leakage, provision to a third party without consent, alteration, etc. of the user's data, including credit cards and bank accounts.
⑧ The "Mall" or a third party who received the personal data from the "Mall" shall destroy the personal data without delay when the purpose of collection or provision of personal data has been achieved.
⑨ The "Mall" shall not set the consent box for the collection, use, and provision of personal data in a selected state. In addition, the "Mall" shall specify the services that are restricted when users refuse to consent to the collection, use, and provision of personal data, and shall not restrict or reject the provision of services, such as signing up for membership, for the reason of the user’s refusal to consent to the collection, use, and provision of personal data items that are not mandatory for collection.

Article 18 (Obligations of the “Mall”)
①The “Mall” shall not engage in acts prohibited by laws and regulations or these terms of use or contrary to public order and morals, and shall do its best to provide goods and services continuously and stably as stipulated in these terms of use.
② The "Mall" shall be equipped with a security system to safeguard users' data (including credit information) so that users can safely use the internet services.
③ The "Mall" shall be responsible for compensating damages to users due to unfair labeling or advertising of goods or services as prescribed in Article 3 of the Act on Fair Labeling and Advertising.
④ The "Mall” shall not send commercial emails that may be unpleasant to users for profit-making purposes.

Article 19 (Obligations for Member ID and Password)
① Except in the case of Article 17, all members are responsible for managing their IDs and passwords.
② All members shall not let a third party use their IDs and passwords.
③ If a member recognizes that his/her ID and/or password has been stolen or used by a third party, he/she shall immediately notify the “Mall” and follow the instructions of the “Mall,” if there are any.

Article 20 (Obligations of Users)
A user shall not be engaged in any of the following:
1. Registering false information upon making a request or change;
2. Stealing other people's information;
3. Changing the information posted on the “Mall”;
4. Transmitting or posting information (computer program, etc.) other than the information set by the “Mall”;
5. Infringing intellectual property rights such as copyrights of the “Mall” or a third party;
6. Committing actions that damage the reputation of the “Mall” or a third party or interfere with their business operations; or
7. Disclosing or posting obscene or violent messages, images, voices, or other information that goes against public order and morals.

Article 21 (Mileage)
1. The "Mall" may grant certain mileage to members when they purchase a product or write product reviews. The specific operating method shall comply with the operating policy of the "Company".
2. The mileage can be used in the same way as the cash value under the criteria for using it at the time of purchasing a product (except for items that have been notified about the unavailability of using the mileage), but they are not refundable in cash. In addition, the mileage service is exclusive to members and cannot be transferred to another person.
3. The granted mileage shall be valid for five (5) years, and unused mileage within the time limit shall be expired.
4. The mileage expires upon a member's withdrawal of membership.
5. If it is confirmed that the points were acquired by fraudulent means, the "Company" may take other measures, such as retrieving the points of the member, deleting his/her ID (identification number), or filing criminal charges.

Article 22 (Coupons)
1. The "Mall" may issue coupons to members using purchasing services to receive a discount on a certain amount or percentage when purchasing pre-designated products.
2. Members can only use the coupons for their own purchases, and under no circumstances can they actually sell or transfer them to others.
3. Use of coupons may be restricted depending on some items or amounts, and coupons cannot be used after the expiration date.
4. Coupons expire upon a member's withdrawal of membership.

Article 23 (Bonus Coupons)
1. The "Mall" may issue bonus coupons to members using purchasing services to receive a discount on a certain amount or percentage when purchasing products (except for items that have been notified about the unavailability of using the coupons).
2. Members can only use bonus coupons for their own purchases, and under no circumstances can they actually sell or transfer them to others
3. Use of bonus coupons may be restricted depending on some items or amounts, and coupons cannot be used after the expiration date.
4. Bonus coupons expire upon a member's withdrawal of membership.

Article 24 (Relationship between the Connecting “Mall” and the Connected “Mall”)
① Where the upper “Mall” and the lower “Mall” are connected via hyperlinks (i.e. hyperlinks that include texts, pictures, or moving images), the former shall be referred to as the connecting “Mall” (website) and the latter the connected “Mall” (website).
② Where the connecting “Mall” indicates that it does not have a warranty liability in relation to any transactions performed with users for the goods, etc. independently provided by the connected “Mall” either on the initial page of the connecting “Mall” or on the pop-up screen at the time of connection, the connecting “Mall” shall assume no warranty liability for the transactions.

Article 25 (Copyright Attribution and Restriction on Use)
① Copyrights and other intellectual property rights for works created by the “Mall” belong to the “Mall”.
② The user shall not use the information for which the intellectual property rights belongs to the “Mall” among the information he/she has obtained without prior approval of the “Mall” in a way that the user uses the obtained information for commercial purposes or lets a third party use the information by means such as copying, transmitting, publishing, distributing, or broadcasting.
③ The "Mall" shall notify the user when using the copyright belonging to the user according to an agreement.

Article 26 (Dispute Settlement)
① The "Mall" shall reflect the legitimate opinions or complaints raised by users and shall install and operate a damage compensation handling organization to compensate for the damage.
② The "Mall" shall handle complaints and opinions submitted by users with priority. However, where swift handling is not possible, the reason and schedule for handling the complaint shall be immediately notified to the user.
③ In the event of a user's request for damage relief in relation to an e-commerce dispute between the "Mall" and the user, the request may be subject to mediation by the Fair Trade Commission or a dispute mediation agency commissioned by the Mayor or Do governor.

Article 27 (Jurisdiction and Governing Law)
① Litigation regarding e-commerce disputes between the “Mall” and users shall take place according to the address of the user at the time of filing, and if there is no address indicated, the district court having jurisdiction over the place of residence shall have exclusive jurisdiction. However, if the address or residence of the user is not clear at the time of filing, or if the user is a foreign resident, the complaint shall be submitted to the competent court under the Civil Procedure Act.
② Korean laws shall apply to e-commerce lawsuits filed between the “Mall” and users.

These terms of use shall take effect from August 1, 2022.
